Q: What if the at fault driver has no insurance?
A: Just because the police officer says the other driver
didn’t have insurance doesn’t make it so. Revo Law will
double check for insured coverage and fully explain how you can
use your own uninsured motorist (UM) coverages, without running
the risk of your rates increasing.
If you own more than one vehicle, New Mexico law allows you to
“stack” your UM coverage together. This is the type
of coverage that you have paid for and it should be used to compensate
you for your injuries if necessary.
Q: How does underinsured motorist
coverage work? (UIM)
A: This is part of your uninsured motorist coverage (UM)
on your policy for which you pay premiums. It is probably the least
known and potentially most valuable coverage you have.
If the at fault driver does not have enough insurance coverage to
fully compensate you for your injuries, you can “stack”
or add together your UM coverage on all your vehicles and then make
a claim for uncompensated or uncovered damages against your own
insurance carrier. If the accident is not your fault, your carrier
cannot drop you or raise your rates.
